Patching, painting and making good shall be provided by others
Clear site access and parking is provided during the hours of 7:30am and 3:30pm Monday to Friday, this excludes public holidays, weekends or after hours; that no delays are caused by others therefore extending our installation time on site.
If major delays are caused (by the customer or any other 3rd parties, eg. other site trades) during the course of the installation which directly affects our programmed works, a variation to our quoted price may occur.
Proposals and sales quotes remain valid for 30 days of above date
KPMTEC does not accept any retentions unless otherwise stated and agreed to
Unless otherwise stated and agreed to, all invoices are due 14 days from date of
invoice.
For projects over $40,000 AUD, unless otherwise stated and agreed to, invoicing breakdown is as follows:
30% on acceptance of proposal prior to ordering equipment;
20% on delivery of goods;
50% on completion of works
Any delivery date or completion date specified in the quotation is an estimate only and KPMTEC does not accept liability for delays in delivery arising from any cause whatsoever.
Failure by KPMTEC to meet delivery date/s shall not enable the Customer to terminate this contract.
All equipment, products, software and licensing remain the property of KPMTEC until final invoice is paid in full.
Warranty services are provided strictly during normal working hours between the times of 7:30am and 3:30pm daily, Monday to Friday excluding any public holidays.
Warranty is limited to replacement or repair and does not include programmed maintenance or labour however so described. Warranty is granted provided:
The purchaser has paid for the goods in whole;
The goods have not been altered, repaired or serviced other than by KPMTEC, its employees or authorised agents;
Damage is not caused by vandalism, neglect, misuse or use in a manner contrary to the instructions or specifications of KPMTEC.
Notwithstanding any other provision of this proposal and except to the extent that liability cannot legally be limited or excluded, KPMTEC total liability for all events giving rise to liability on its part arising out of or in connection with this proposal (including in respect of its liability to indemnify the Principal) shall be limited to the Contract Value per any event and the Contract Value in total aggregate.
In no event shall the KPMTEC be liable for indirect or consequential loss or damage, loss of contract, profit or revenue, production stoppage or replacement services.
The limitation of liability contained in this clause shall apply whether the liability claim is based on breach of contract, breach of warranty, tort, negligence, strict liability or other legal theory.
